After assessing the report of an investigation into a complaint, the Office of the Police Ombudsman may recommend to the Commissioner of Police that:

  • no action be taken; the designated officer/s be charged with a breach of discipline. In the event that the officer is charged with a breach of discipline the matter will be heard and determined by the Police Disciplinary Tribunal;
  • the matter be referred to the Director of Public Prosecutions with a view to determining whether the designated officer/s should be charged with a criminal offence; or
  • some other form of action be taken including, for example, that SAPOL amend a policy or procedure.
